Terms of Service
Welcome to hwcfurniture.com. In these Terms, "we", "us" and "our" mean Harden Mobilya Dekorasyon Mühendislik İthalat İhracat Sanayi ve Ticaret Limited Şirketi, trading as Harden Wood Co. ("HWC"), a company registered in Türkiye, registered address Önder Mah. Çamlıtepe Cad. No: 309, Interior Door No: 4, Altındağ / Ankara, Türkiye, trade registry number 456853, tax number 4571217322.
These Terms, together with our Privacy Policy, Returns & Refunds Policy and Shipping & Delivery Policy, govern your use of this website and your purchase of our products (together, the "Services").
Please read them carefully. They contain important information about your rights, and about the limits of our liability. By browsing, interacting with or ordering through the Services, you agree to be bound by them. If you do not agree, please do not use the Services.
1. Eligibility and your account
You confirm that you are of legal age in your country of residence and legally able to enter into a contract. You may be asked to provide an email address, billing details and a delivery address. You confirm that the information you give us is accurate, current and complete, and that you are entitled to provide it. You are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell or license your account to anyone else.
2. Our products
Every HWC product is made by hand from solid wood in our workshop in Ankara. We make every effort to represent our products accurately, but:
- grain, colour tone, knot distribution, live edge form and the shape of an epoxy river vary between individual pieces and cannot be reproduced identically;
- colours may appear different on your screen depending on your device and ambient lighting.
These variations are inherent to the material and are described further in our Returns & Refunds Policy. Product descriptions, specifications and availability may change at any time. We may limit or discontinue any product, and may restrict the quantities we sell to any person, region or jurisdiction.
3. Orders
When you place an order you are making an offer to buy. Your order is accepted only when we confirm acceptance to you; a payment authorisation or an automated order-received email is not, by itself, acceptance. We may decline any order at our discretion, including where we cannot verify your payment or delivery details, where a product has been listed at a manifestly incorrect price, or where we cannot ship to your destination.
Please check your order carefully before submitting it. Because production begins shortly after acceptance, we may be unable to change or cancel an order once it has been accepted. If we cannot accept, need to change, or must cancel your order, we will contact you using the email address or telephone number you provided and refund you in full where payment has been taken.
You confirm that products you buy are for your own personal or household use and not for commercial resale.
4. Custom and made-to-order production
Most of what we sell is manufactured after you order it, to the size and specification you select. Where you order a size, finish, wood species, height, leg design or other feature that is not one of the standard options listed on the product page, the item is made to your specifications and the right of withdrawal does not apply to it. This is set out in full, with its legal basis, in section 2 of our Returns & Refunds Policy. If you are unsure whether your configuration is treated as custom, ask us in writing before ordering.
For epoxy river tables we photograph the wood we intend to use and send it for your approval before pouring. Once you approve, production proceeds on that basis.
Lead times given on the product pages and in the Shipping & Delivery Policy are good-faith estimates based on our normal workshop schedule. They are not guaranteed delivery dates. If a material delay arises we will tell you promptly and you may choose to wait, to agree a substitute, or to cancel and receive a full refund.
5. Prices, payment and taxes
All prices are shown in Turkish Lira (TRY) and are charged in Turkish Lira. If you pay with a card issued outside Türkiye, your bank converts the amount at its own rate and may apply a foreign transaction fee; that conversion and any such fee are between you and your bank, and are outside our control.
Prices shown to customers outside Türkiye are exclusive of Turkish VAT, as export sales are zero-rated under Turkish law.
For international orders we ship DDP (Delivered Duty Paid): the price you pay at checkout includes freight, export documentation, import duty and the import VAT of your country. You will not be asked for further payment on delivery.
Prices may change at any time before your order is accepted. We are not obliged to honour a price that is obviously incorrect. Payment is processed by our payment provider; we do not store your full card details.
6. Shipping, delivery and returns
Delivery, transit times, packaging, inspection on arrival and damage claims are governed by our Shipping & Delivery Policy. Returns, withdrawal rights, faulty goods and refunds are governed by our Returns & Refunds Policy. Both form part of these Terms.
Risk in the goods passes to you on delivery. Title passes to you when we have received payment in full.
7. Care of your table
Solid wood and epoxy require care. Guidance for each product is given on its product page. Damage caused by failure to follow that guidance — including prolonged exposure to water, use of abrasive chemicals, placing hot items directly on the surface, or sustained direct sunlight — is not covered by any warranty or guarantee.
8. Intellectual property
All content on this website, including photographs, product designs, text, logos, and the HWC and Harden Wood Co. names, is owned by us or licensed to us and is protected by intellectual property law. You may view and print content for your own personal, non-commercial use. You may not reproduce, republish, distribute or use it commercially, or use our product photographs in your own listings or advertising, without our prior written permission.
9. Content you submit
If you send us reviews, comments, photographs or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that material in connection with our business, including on our website and social media. You confirm that the material is yours to give, that it is accurate, and that it does not infringe anyone else's rights or contain unlawful content. We may remove any submitted content at our discretion, and we are under no obligation to publish or keep it.
10. Acceptable use
You agree to use the Services only for legitimate enquiries and orders. You agree not to place speculative, false or fraudulent orders; not to attempt to gain unauthorised access to the Services; not to interfere with their operation; not to scrape or systematically extract data from them; and not to use them for any unlawful purpose. If we reasonably believe an order is fraudulent, we may cancel it and inform the relevant authorities.
11. Third-party links and services
This store is hosted on Shopify. Our website may contain links to third-party websites and rely on third-party payment, shipping and analytics providers. We are not responsible for the content, policies or practices of third parties, and their inclusion does not imply endorsement.
12. Disclaimers
We aim to keep the Services available and accurate, but we do not warrant that they will be uninterrupted, error-free or free of harmful components, or that any information on them is complete or current at all times. Except as expressly stated in these Terms and in the policies referred to in them, and except for warranties that cannot be excluded by law, the Services are provided "as is".
13. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under applicable product liability law, or for any other liability that cannot lawfully be limited or excluded — including your statutory rights as a consumer.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of opportunity, and our total liability arising out of or in connection with any order is limited to the amount you paid for that order.
14. Events outside our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, fire, epidemic, war, civil unrest, strikes, failures of transport or utility networks, customs action, or changes in law or tariffs. If such an event occurs we will notify you within a reasonable time, and you may choose to wait, to agree a substitute, or to cancel your order for a full refund of amounts paid.
15. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or your unlawful use of the Services.
16. Changes to these Terms
We may update these Terms from time to time. The version in force at the moment you place an order is the version that applies to that order. We recommend that you review them before each purchase.
17. Severability and waiver
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of it.
18. Governing law and jurisdiction
These Terms and any contract formed under them are governed by the laws of the Republic of Türkiye, and the courts of Ankara, Türkiye have jurisdiction.
This does not deprive you of the protection of any mandatory consumer-protection rules of the country in which you habitually reside. If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law grants you mandatory rights, those rights continue to apply to you, and you may bring proceedings in the courts of your country of residence.
